1. Acceptance of Terms

By accessing, downloading, installing, or using the SecureWave VPN service, website, or applications (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must not use the Service.

These Terms constitute a legally binding agreement between you ("User," "you," or "your") and SecureWave ("Company," "we," "us," or "our"). We may update these Terms from time to time, and your continued use of the Service after such changes constitutes acceptance of the revised Terms.

You represent that you are at least 13 years of age (or the minimum legal age in your jurisdiction) and have the legal capacity to enter into these Terms. If you are using the Service on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms.

2. Description of Service

SecureWave provides a virtual private network (VPN) service that encrypts your internet connection and routes your traffic through secure servers to protect your privacy and security online. The Service includes:

  • Encrypted VPN tunnels -- utilizing WireGuard and other industry-standard protocols to secure your internet traffic with military-grade encryption (AES-256-GCM, ChaCha20-Poly1305).
  • Privacy protection -- masking your IP address and encrypting your data to prevent third-party surveillance, tracking, and interception.
  • Multi-platform applications -- native applications for iOS, Android, macOS, Windows, and Linux.
  • Global server network -- access to VPN servers in multiple geographic locations for optimized performance and connectivity.
  • No-logs policy -- a strict commitment not to log, monitor, or store your browsing activity, DNS queries, or traffic content.
  • Advanced threat detection -- ML-based anomaly detection to identify and mitigate network threats in real time.

The specific features available to you depend on your subscription plan. Feature availability may vary by platform and region.

3. Account Registration

To use the Service, you must create an account. When registering, you agree to:

  • Provide accurate information -- you must provide a valid email address and truthful information during registration. You are responsible for keeping your account information current.
  • Maintain password security -- you are solely responsible for maintaining the confidentiality of your password and for all activities that occur under your account. Use a strong, unique password that you do not use for other services.
  • One account per person -- each account is intended for use by a single individual. You may not share your account credentials with others or create multiple accounts to circumvent plan limitations.
  • Notify us of unauthorized access -- you must immediately notify us if you become aware of any unauthorized use of your account or any other breach of security.

We reserve the right to suspend or terminate accounts that violate these requirements. We are not liable for any loss or damage arising from your failure to maintain the security of your account credentials.

4. Subscription and Billing

4.1 Plans and Pricing

SecureWave offers multiple subscription plans with varying features, device limits, and billing cycles. Current plan details and pricing are available on our Pricing page. Prices are displayed in US dollars unless otherwise stated and are exclusive of applicable taxes.

4.2 Billing Cycles

Subscriptions are billed in advance on a recurring basis according to the billing cycle you select (monthly, annual, or as otherwise offered). The billing cycle begins on the date of your initial purchase and renews automatically on the same date each cycle.

4.3 Auto-Renewal

Your subscription will automatically renew at the end of each billing cycle unless you cancel before the renewal date. You will be charged the then-current rate for your plan at each renewal. We will send a reminder email at least 7 days before each renewal.

4.4 Payment Methods

We accept payment via credit card and debit card, processed through our third-party payment provider (Stripe). By providing a payment method, you authorize us to charge the applicable subscription fees to that payment method.

4.5 Refund Policy

We offer a 30-day money-back guarantee for new subscribers. If you are not satisfied with the Service within the first 30 days of your initial subscription, you may request a full refund by contacting our support team. Refunds are processed within 10 business days. This guarantee applies to the first subscription period only and does not apply to renewals, upgrades, or additional purchases.

4.6 Price Changes

We reserve the right to adjust pricing at any time. Any price changes will take effect at the start of your next billing cycle. We will provide at least 30 days notice of any price increase via email.

5. Acceptable Use

You agree to use the Service responsibly and in compliance with all applicable laws. The following activities are strictly prohibited:

  • Illegal activity -- using the Service to engage in or facilitate any activity that violates local, state, national, or international laws or regulations.
  • Network abuse -- sending spam, launching denial-of-service attacks, distributing malware, or engaging in any activity that disrupts or damages networks, servers, or infrastructure (whether ours or third parties').
  • Unauthorized access -- attempting to gain unauthorized access to computer systems, networks, or data, including through hacking, phishing, or credential theft.
  • Circumventing restrictions unlawfully -- using the Service to circumvent geographic restrictions, access controls, or licensing limitations in a manner that violates applicable laws or third-party terms of service.
  • Intellectual property infringement -- using the Service to infringe upon the intellectual property rights of others, including unauthorized distribution of copyrighted material.
  • Account sharing -- sharing your account credentials with others, selling access to your account, or allowing multiple individuals to use a single account beyond the simultaneous device limits of your plan.
  • Abuse of resources -- consuming disproportionate amounts of server resources or bandwidth in a manner that degrades the Service for other users.
  • Harmful content -- using the Service to distribute, store, or transmit content that is threatening, abusive, defamatory, or promotes violence or discrimination.

We reserve the right to investigate suspected violations and take appropriate action, including suspension or termination of your account, without prior notice. We may cooperate with law enforcement authorities if required by law.

6. Intellectual Property

All content, features, and functionality of the Service, including but not limited to the SecureWave name, logo, trademarks, software, source code, design, text, graphics, and documentation, are owned by SecureWave or its licensors and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

Your subscription grants you a limited, non-exclusive, non-transferable, revocable license to use the Service and its applications for personal, non-commercial purposes in accordance with these Terms. You may not:

  • Copy, modify, distribute, sell, or lease any part of the Service or its software.
  • Reverse engineer, decompile, or disassemble the software, except as permitted by applicable law.
  • Use our trademarks, logos, or brand elements without prior written consent.
  • Remove, alter, or obscure any copyright, trademark, or other proprietary notices.
  • Create derivative works based on the Service or its components.

7. Privacy

Your privacy is fundamental to our Service. Our collection, use, and handling of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.

By using the Service, you acknowledge that you have read and understood our Privacy Policy and consent to the practices described therein. Key commitments include our strict no-logs policy regarding your browsing activity, DNS queries, and traffic content.

8. Limitation of Liability

To the maximum extent permitted by applicable law:

  • The Service is provided on an "as is" and "as available" basis without warranties of any kind, whether express, implied, statutory, or otherwise, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
  • We do not warrant that the Service will be uninterrupted, error-free, secure, or free of viruses or other harmful components.
  • We do not guarantee any specific level of anonymity, privacy, or security beyond our stated practices.
  • In no event shall SecureWave, its officers, directors, employees, or agents be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, or goodwill, arising out of or in connection with your use of the Service.
  • Our total aggregate liability for any claims arising from or relating to the Service shall not exceed the amount you paid to us during the twelve (12) months preceding the event giving rise to the claim.

Some jurisdictions do not allow the exclusion or limitation of certain warranties or liabilities, so the above limitations may not apply to you in full. In such cases, our liability will be limited to the greatest extent permitted by law.

9. Service Availability

We strive to maintain the highest possible uptime and service reliability. However, we do not guarantee uninterrupted availability of the Service. The Service may be temporarily unavailable due to:

  • Scheduled maintenance -- we perform regular maintenance to improve performance and security. Where possible, we will provide advance notice of planned maintenance via email or in-app notification.
  • Emergency maintenance -- critical security patches or infrastructure issues may require immediate action without prior notice.
  • Circumstances beyond our control -- including natural disasters, power outages, network failures, government actions, or other force majeure events.

We will make commercially reasonable efforts to minimize downtime and restore service as quickly as possible. We are not liable for any damages resulting from service interruptions.

10. Termination

10.1 Termination by You

You may cancel your subscription and close your account at any time through your account settings or by contacting our support team. Upon cancellation:

  • Your subscription will remain active until the end of your current billing period.
  • You will not be charged for subsequent billing periods.
  • Your account data will be deleted within 30 days of the effective cancellation date, as described in our Privacy Policy.

10.2 Termination by Us

We reserve the right to suspend or terminate your account, with or without notice, if:

  • You violate any provision of these Terms, including the Acceptable Use policy.
  • Your payment method fails and is not resolved within a reasonable period.
  • We are required to do so by law or legal process.
  • We reasonably believe your account has been compromised.
  • Continued provision of the Service to you would pose a security risk to us or other users.

In cases of termination for cause, we are under no obligation to provide a refund for any unused portion of your subscription.

10.3 Effect of Termination

Upon termination, your right to use the Service ceases immediately. Sections of these Terms that by their nature should survive termination (including Intellectual Property, Limitation of Liability, Governing Law, and any accrued obligations) will continue to apply.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. Any disputes arising from or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the state and federal courts located in the State of Delaware.

If any provision of these Terms is held to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision.

12. Changes to Terms

We may revise these Terms from time to time. When we make material changes:

  • We will update the "Last updated" date at the top of this page.
  • We will notify you via email at least 14 days before the revised Terms take effect.
  • We will display a notice within the application alerting you to the change.
  • For significant changes that affect your rights or obligations, we may require you to affirmatively accept the new Terms before continuing to use the Service.

If you do not agree with the revised Terms, you must stop using the Service and cancel your subscription before the changes take effect. Continued use of the Service after the effective date of revised Terms constitutes acceptance.
